Terms of Service for PassDeck

Welcome to PassDeck. These Terms of Service govern your access to and use of the PassDeck website, mobile application, exam simulator, practice tools, and related services.

By accessing or using PassDeck, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

1. About PassDeck

PassDeck is an independent online exam simulation and review platform designed to help users prepare for examinations through mock tests, practice questions, performance analytics, and self-assessment tools.

PassDeck provides educational and review-based content for exam preparation including, but not limited to:

  • MARINA / Seafarer examinations
  • Civil Service examinations
  • Licensure Examination for Teachers (LET)
  • Board examination review
  • Professional certification preparation
  • Government entrance and qualifying examinations

PassDeck is intended solely for review, mock examination, and educational self-assessment.

2. No Government Affiliation

PassDeck is privately developed and independently operated.

PassDeck is not affiliated with, endorsed by, sponsored by, or officially connected with the Professional Regulation Commission (PRC), Civil Service Commission (CSC), Maritime Industry Authority (MARINA), Department of Education (DepEd), or any government agency, licensing body, examination authority, or educational institution.

All trademarks, service marks, logos, and agency names remain the property of their respective owners.

3. User Accounts

To access certain features, users may be required to create an account.

You agree to:

  • provide accurate and complete registration information
  • maintain the confidentiality of your login credentials
  • be responsible for activities under your account
  • notify PassDeck immediately of unauthorized access or suspicious use

PassDeck reserves the right to suspend, restrict, or terminate accounts that violate these Terms.

4. Subscription, Billing, and Payments

PassDeck may offer free and paid plans, including subscription-based access.

By purchasing a subscription, you agree that:

  • fees will be charged according to the selected plan
  • billing may be processed through third-party payment providers
  • prices may change in the future with notice before renewal where applicable
  • access to premium features depends on successful payment

Unless otherwise stated, subscription fees are non-refundable once access has been granted.

Refund requests may be reviewed on a case-by-case basis where required by law or platform policy.

5. Permitted Use

PassDeck grants you a limited, non-exclusive, non-transferable right to access and use the platform for personal educational and review purposes.

You agree not to:

  • copy, reproduce, republish, or distribute platform content without permission
  • resell, sublicense, or commercially exploit any content from PassDeck
  • share paid accounts with unauthorized users
  • attempt to scrape, harvest, extract, or download large portions of the question database through automated means
  • interfere with platform operations or security
  • attempt unauthorized access to accounts, servers, or databases
  • upload malware, harmful code, or disruptive material
  • misuse the platform in violation of applicable law

6. Educational Content Disclaimer

PassDeck provides mock exams, review materials, practice questions, simulations, explanations, and performance tools solely for educational and self-assessment purposes.

PassDeck does not represent, guarantee, or claim that:

  • any material is an official government examination
  • any material is an official examination answer key
  • use of the platform guarantees passing any examination
  • content originates directly from any testing authority

Practice questions may be compiled, adapted, organized, rewritten, or presented from various educational references and review materials to simulate exam experience.

7. No Guarantee of Exam Results

PassDeck is designed to assist with preparation only.

While many users may benefit from practice and review, PassDeck does not guarantee:

  • passing scores
  • board exam success
  • licensure approval
  • employment qualification
  • certification issuance

Individual exam outcomes depend on many personal factors beyond the platform's control.

8. Intellectual Property

All platform software, branding, design elements, analytics tools, databases, text, interface components, and related materials made available through PassDeck are protected by applicable intellectual property laws.

PassDeck retains ownership over the platform structure, software functionality, design, branding, and original materials created for the service.

Users may not copy or reproduce any protected materials except as permitted for personal review use within the platform.

9. Availability of Service

PassDeck works to maintain platform availability but does not guarantee uninterrupted service.

Access may occasionally be interrupted due to:

  • maintenance
  • upgrades
  • server downtime
  • third-party provider interruptions
  • internet or technical issues beyond reasonable control

PassDeck may update, modify, suspend, or discontinue features at any time.

10. Limitation of Liability

To the fullest extent allowed by law, PassDeck shall not be liable for:

  • failed exam outcomes
  • lost study time
  • missed deadlines
  • interruption of service
  • account access issues
  • data loss caused by third-party failures
  • indirect or consequential damages resulting from use of the platform

Use of PassDeck is at the user's own discretion and responsibility.

11. Privacy

Use of PassDeck is also governed by the PassDeck Privacy Policy, which explains how personal data is collected, processed, stored, and protected.

By using PassDeck, you also agree to the Privacy Policy.

12. Termination of Access

PassDeck may suspend or terminate access immediately if a user:

  • violates these Terms
  • abuses the platform
  • shares accounts fraudulently
  • attempts unauthorized copying or extraction of content
  • engages in unlawful or harmful conduct

Termination may occur with or without prior notice where necessary to protect the platform or users.

13. Changes to Terms

PassDeck may revise these Terms from time to time.

Updated Terms will be posted on this page with a revised effective date.

Continued use of PassDeck after changes are published constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines.

Any disputes arising from or related to the use of PassDeck shall be subject to applicable Philippine laws and the proper courts of the Philippines.
